Plain terms for a small app. Nothing here is meant to surprise you, and you agreed to them when you signed in.
Who may use KidDay
You must be 18 or older and the parent or guardian of any child you add. The account is yours, not your child's. If you are adding a child you are not responsible for, you need their parent's permission first.
What KidDay is
KidDay suggests a few things to do with a child on a given morning, drawn from public library, park and museum calendars in the Washington DC area. It is a starting point for a plan. It is not a booking service, not a childcare service, and not a recommendation of anybody.
The listings come from other people
Times, ages, prices and opening hours are read from published calendars and can be wrong, out of date, or changed after we read them. Check with the venue before you travel, especially for anything that needs registration or costs money. We show when we last checked a listing so you can judge for yourself.
You decide what is suitable and safe for your own child. We do not inspect venues, we do not vet the organisations running these events, and a listing appearing here is not an endorsement of the people running it.
Things you add
If you submit an event or write a note: only submit something you have the right to post, keep it accurate, and keep it appropriate for children. Do not post anything that identifies a child.
You keep ownership of what you write. You give us a non-exclusive, worldwide, royalty-free licence to store, display, format and share it as part of running KidDay — which includes showing it to other parents and including it in a plan someone shares by link. That licence ends when you delete the content, except for copies already shared by link, which expire on their own within seven days.
Everything submitted is reviewed before any other parent can see it, and we can decline or remove anything. Persistent misuse ends the ability to submit.
Notes are public
There is no private note. Anything you write about a place is visible to every other parent looking at that place, shown with your first name and your child's age. Do not put anything in a note that identifies your child or someone else's. You can delete a note at any time, and notes stop being shown after about a year.
If you think something here infringes your copyright
Write to privacy@kiddayout.com with: what work you own, where it appears on KidDay, your contact details, a statement that you believe in good faith the use is not authorised, a statement that your notice is accurate and that you are the owner or authorised to act, and your signature. We will remove or disable the material promptly and tell whoever posted it, who may reply with a counter-notice.
Your account
Sign-in links are personal — anyone holding one can sign in as you, so do not forward them. You can delete your account yourself at any time, from the You tab. We may suspend or end an account being used to abuse the service or other people, and will say why unless saying why would make the abuse worse.
What we do not promise
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not promise the service will always be available, always be accurate, or always suit you.
TO THE FULLEST EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL LOSS, AND OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO 100 US DOLLARS — KidDay is free, so this is a floor rather than a refund. We are not responsible for what happens on an outing you chose to go on.
Nothing in these terms limits any right you have that cannot be limited by agreement, including anything relating to death or personal injury caused by negligence, or any right you have as a consumer under the law where you live. Some places do not allow the exclusions above, in which case they do not apply to you.
If you break these terms
You agree to cover our reasonable costs if a claim is brought against us because of something you posted or something you did with the service that these terms do not allow. This does not apply to anything that is our fault.
The rest
If any part of these terms is unenforceable, the rest still stands. Not enforcing something once does not waive it. You may not transfer your account; we may transfer these terms if the service does. Neither of us is responsible for failures outside our reasonable control. These terms and the privacy policy are the whole agreement between us about KidDay.
Which law applies
KidDay is offered for the Washington DC area and is run by an individual, not a company. These terms are governed by the laws of the State of Maryland, and any dispute belongs in the state or federal courts sitting in Montgomery County, Maryland — the place the service is about, and where almost everyone using it lives.
This does not take away rights you have where you live. If the law where you live gives you consumer protections that cannot be signed away, or the right to bring a claim locally, you keep them, and nothing above applies to the extent it would remove them.
Changes
The date at the top changes when these terms change. If a change materially affects what you agreed to, we will ask you to agree again the next time you sign in rather than assume.
